“California Proposition 65”
In 1986, the voters of California passed Proposition 65 (commonly referred to as “Prop 65”), the Safe Drinking Water and Toxic Enforcement Act. This law applies to any product sold or distributed within the State of California.
Prop 65 requires that individuals must be warned of exposure to certain chemicals identified by the State of California as causing cancer or reproductive harm, in order that they can protect themselves from exposure and reduce the amount of chemicals released into California’s water supply.
California Prop 65 does not ban any product. Rather, it provides information to the residents of California about the listed chemicals present in the products they purchase and/or use. The initiative requires the Governor to publish a list of substances that are known to the State of California to cause cancer, birth defects or other reproductive harm. Currently, more that 700 chemicals are listed by the State as known carcinogens or reproductive toxins.
Prop 65 requires businesses to provide residents of the state “clear and reasonable” warning about listed chemicals that are or may be present in the products they make available for sale or distribution in California.
The warning may be in the form of a label on a product, a letter, web posting, package insert, or a notice or sign suitable for posting (such as a copy of this document). Laerdal therefore, in compliance with State of California requirements, provides the following statement:
Important information for users of Laerdal products in the State of California:
WARNING:
Laerdal’s products contain/may contain chemicals known to the State of California to cause cancer or birth defects or other reproductive harm.
Additionally, when a business is not able to communicate directly with the persons who may actually use its products and become exposed to the listed chemicals, the actual supplier of the products to those persons/users has the independent duty to provide warning information to those persons. If you are not the product user, please pass this notice to the user together with the product.
